Terms of service
These terms cover the hosted service at app.misomoon.com. The misomoon software is open source under the MIT license, and running it yourself is governed by that license and by your agreement with Cloudflare, not by these terms.
Draft. Items in square brackets need filling in, and a lawyer should review the terms before they are published.
1. Who we are
[Legal name], [registered address], [registration number] ("we"). Contact: support@misomoon.com.
2. Your account
You need to be at least 16, and old enough to make a contract where you live. Keep your password and API keys safe; you are responsible for what is done with them. A team's owners are responsible for the people they invite.
3. Your data
Your sites' statistics belong to you. We process them only to run the service, under the data processing agreement, which is part of these terms. You can export them at any time. Privacy policy covers your account data.
4. What you may not do
- Track people without the notice or consent the law where you operate requires.
- Send names, email addresses, or other details that identify a person in events, properties, or page paths, or special categories of data such as health or religion.
- Measure a site you have no right to measure.
- Break, overload, or probe the service, other than under the vulnerability disclosure policy.
- Use the service for anything unlawful.
We may stop accepting data for a site that breaks these rules, and tell you why.
5. Plans and payment
[Plans, prices, billing period, taxes, and what happens when you go over a plan's limit. Prices may change with [30] days' notice; a change applies from your next billing period.]
6. Availability and changes
We work to keep the service running, but don't promise it is never down. Status: [status page]. We may change or remove features; we tell you [30] days before removing one you pay for.
7. Ending
You can delete your account at any time in Settings > Account. We may end the service for you with [30] days' notice, or at once if you seriously break these terms. After the account ends, we delete your data as the data processing agreement says.
8. Liability
The service is provided as it is. As far as the law allows, neither party is liable for indirect or consequential loss, and each party's total liability is limited to the fees you paid in the 12 months before the claim. Nothing limits liability that the law doesn't allow to be limited, such as for fraud or for death or injury caused by negligence.
9. Changes to these terms
We date every change here, and email account owners [30] days before a change takes effect. If you don't agree, you can delete your account before then.
- [date]: first version.
10. Law
These terms are governed by [governing law], and the courts of [place] decide disputes. If you are a consumer, you keep the protection of the law where you live.
